ACA Section 1557 Nondiscrimination Resources

 To comply with the Affordable Care Act Department of Health and Human Services (HHS) Final Rule, Nondiscrimination in Health Programs, Section 1557, all covered entities must post a notice regarding their nondiscrimination policies by October 16, 2016. This also includes posting a notice in the 15 most common languages spoken in Missouri, that the practice offers free, accurate and timely language assistance to individuals with limited English proficiency and that the practice offers free auxiliary aids and services for individuals with disabilities. This information must be posted in conspicuous physical locations and font size where the entity serves the public, on its website (accessible from its homepage), and insignificant publications and communications targeted at applicants and members of the public. All covered entities must file an assurance of compliance with the HHS Office of Civil Rights (this is typically done when you apply to participate in federal assistance programs such as Medicare).

Section 1557 is the nondiscrimination provision of the Affordable Care Act (ACA). The law prohibits discrimination based on race, color, national origin, sex, age, or disability in health programs or activities that receive Federal financial assistance or are administered by an Executive agency or any entity established under Title I of the ACA.
